Introduction and effectiveness of the General Conditions (pursuant to Chapter I, Title 3, Part 3, of Legislative Decree 206\/2005 \u201cConsumer Code\u201d and subsequent amendments and additions). These general conditions of sale (hereinafter \u201cGeneral Conditions\u201d) have as their object the regulation of the purchase of products made remotely and made available, via the Internet, from the site https:\/\/www.paranobio.com (hereinafter \u201cSite\u201d) in compliance with the Consumer Code pursuant to Legislative Decree 206\/2005 and subsequent amendments and additions. <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

1. Owner of the website<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

FLSNLM63A14A701H, P.I. 01318490560, REA n. VT \u2013 78856, email address: amministrazione@paranobio.it, tel. (+39) 3201516073 (hereinafter \u201cAzienda Agricola Parano di Filesi Anselmo\u201d).<\/p>

The consumer who uses the Site to make purchases (hereinafter \u201cCustomer\u201d) is required, before sending the order, to carefully read and accept these General Conditions via the link contained in the order checkout page. These General Conditions can be consulted at any time on the Site in the \u201cGeneral Conditions\u201d section. In the absence of such express acceptance of the General Conditions, it will not be possible to complete the online purchase procedure.<\/p>

If the person making purchases on the Site requests the issuing of an invoice by providing their tax code\/VAT number and\/or is not a \u201cconsumer or user\u201d as defined by art. 3, paragraph 1, letter a), of the Consumer Code, or if the amount to be paid is less than \u20ac50.00, the withdrawal provisions set out in art. 7 of these General Conditions will not apply, nor, more generally, the provisions that apply only to \u201cconsumers\u201d under the same Consumer Code.<\/p>

The present General Conditions apply to purchases concluded with Azienda Agricola Parano di Filesi Anselmo through the Site in compliance with Italian law. Minors under the age of 18 are not allowed to purchase Products through the Site. The languages available to conclude the contract are Italian and English.<\/p>

It is specified that, unless expressly indicated, all brands and names indicated in these General Conditions and on the Site are not the property of Azienda Agricola Parano di Filesi Anselmo or of companies connected to it.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

2. Product selection and ordering<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The page relating to each product (hereinafter \u201cProduct\u201d or \u201cProducts\u201d) for sale on the Site or advertised via Meta platforms reports all of its characteristics, specifications and price.<\/p>\n

Purchase via the Site: The Customer who accesses the Site (which uses secure servers: HTTPS protocol and SSL certificate) to purchase the Products may place the order by entering their data in the checkout form and choose whether to register their account on the Site to allow for faster execution of the data entry process for the next order, using the credentials (username and password) chosen after having carefully read the privacy policy. Use of the Site and purchase of the Products is also permitted without user registration. The user will be managed as a guest user and will have to re-enter their billing and shipping data for subsequent orders. <\/p>\n

The Customer will therefore be able to choose and add the products with the characteristics, weight and quantity chosen to the “Cart”. To finalize the sending of the order, the Customer must fill out the order form by entering the shipping and billing information, select the delivery and payment method and, after having read and accepted these General Conditions (which can also be viewed at any time on the Site in the General Conditions section), confirm the order and proceed with the relative payment by credit card (Visa\/Mastercard\/American Express) directly on the checkout page, where, if the user uses the iOS, macOS, watchOS operating systems of Apple Inc., it will also be possible to use the Apple Pay service: the Site will automatically recognize the presence of a valid credit card or prepaid card in the iOS Wallet app and will present the user with the “Pay with Apple Pay” button. At this point, everything will be managed thanks to the integration of the Site with the operating system owned by Apple Inc and the user will not have to enter the billing and credit card information again. For more information on the Apple Pay system, please refer to the official service page: https:\/\/www.apple.com\/It\/apple-pay. Alternatively, the user can choose to pay via the Paypal system that can be used with the major credit circuits (Visa\/Mastercard\/Discover\/American Express\/Maestro\/Carta Aura etc.) according to the methods accepted by Paypal and in compliance with the relevant conditions. <\/p>\n

The total cost of the purchase includes shipping costs and will be calculated automatically from the order page once all the data has been entered. The contract stipulated between Azienda Agricola Parano di Filesi Anselmo and the Customer must be considered concluded with the acceptance of the order by Azienda Agricola Parano di Filesi Anselmo. This acceptance is communicated to the Customer through a message confirming receipt of payment or order confirmation containing the order number, shipping and billing data, the list of Products ordered with their essential characteristics and the total price, including delivery costs. <\/p>\n

Pursuant to and for the purposes of Articles 1341 and 1342 of the Civil Code, by accepting the General Conditions, the Customer declares to have carefully read and exactly understood all the clauses indicated in this contract.<\/p>\n

By accepting these General Conditions, the Customer also declares, under his\/her own responsibility, that he\/she has reached the age of majority.<\/p>\n

For this purchase method, the Customer will check the order confirmation email\/message and, if he\/she finds any errors in the order itself, he\/she will have 12 hours from the receipt of such email\/message to contact Customer Service directly from the Site using the appropriate contact form or using the email address: info@paranobio.com. After this period, the order will be processed for shipping and no changes will be accepted, without prejudice to the Customer’s rights as per the following article 7. <\/p>\n

Once the order has been received, Azienda Agricola Parano di Filesi Anselmo will check the availability of stocks to process the order. In the event that one or more Products are not available, the Customer Service will promptly send an email to the Customer who, within the following 12 hours, will have the right to respond to confirm the shipment of any additional available Products or cancel it. In the event of no response within this period, the order will be considered confirmed and the available Products will be shipped. In this case, the entire amount relating to the missing Products will be refunded or, in any case, depending on the chosen payment method, will not be charged to the Customer. <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The information, prices expressed in euros and characteristics relating to the Products are available, with the relative Product codes, on the Site.<\/p>\n

The visual representation of the Products on the Site, where available, normally corresponds to the photographic image accompanying the descriptive sheet. It is understood that the image of the Products themselves has the sole purpose of presenting them for sale and may not be perfectly representative of their characteristics and quality but may also differ in color and size. In the event of a difference between the image and the written product sheet, the description of the product sheet always prevails. <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

4. Prices and shipping<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The prices of the Products include all taxes and duties. All prices are expressed in Euros. The cost of shipping varies based on the total weight of the Products purchased and the final destination of delivery. On the Cart page, the user can view the actual cost of shipping and the general conditions of transport of the carrier through a specific link, before proceeding to accept the General Conditions and payment. <\/p>\n

Deliveries are made throughout Italy and are made via Express Courier GLS, BRT, TNT, UPS, DHL (hereinafter, \u201cCourier\u201d).<\/p>\n

More detailed information on shipping methods and costs is available at any time on the Site in the Shipping and Deliveries section.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

5. Payment methods and invoicing<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Once the order has been confirmed, the Customer may pay the price of the Products and the related delivery costs directly with his\/her credit card (Visa\/Mastercard\/American Express), with the possibility of taking advantage of the integration of the Site with Apple Pay, as described in chapter 2 of these General Conditions, or with his\/her Paypal account where it is possible to use a credit card belonging to the major credit circuits (Visa\/Mastercard\/Discover\/American Express\/Maestro\/Carta Aura etc.) according to the methods accepted by Paypal and in compliance with the relevant conditions.<\/p>\n

\u2013 Invoicing of orders: if the purchase is made by a professional by entering his\/her billing information (tax code\/VAT number) in the appropriate space during the order process, an invoice will be automatically generated. In this case, the invoice will be sent together with the Products purchased by the professional. The professional is responsible for the correct entry of the billing information and is expressly informed that, in the event of failure to request the invoice during the order phase, it will not be possible to request it later. <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

6. Transport and delivery<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure. All purchases will be delivered by Courier from Monday to Friday, excluding holidays and national holidays. Azienda Agricola Parano di Filesi Anselmo is not responsible for delays that are not foreseeable or not attributable to it. <\/p>\n

Once the shipment has been taken over, the Courier will send the Customer an email notifying them that the shipment has been entrusted to them together with the tracking number relating to the shipment.<\/p>\n

In any case, except in cases of force majeure or unforeseeable circumstances, the Products ordered will be delivered within 4 working days starting from the day following the day on which Azienda Agricola Parano di Filesi Anselmo confirmed the order to the Customer via a specific order confirmation email.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

7. Right of withdrawal<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The Customer has the right to withdraw from the contract as established by <\/p>\n

Legislative Decree no. 21 of 21 February 2014 (link). <\/p>\n

The Customer has the right to withdraw from the contract, without giving any reason, within 14 days. The withdrawal period expires after 14 days from the day on which the Customer or a third party, other than the carrier and the designated Customer, acquires physical possession of the goods. <\/p>\n

To exercise the right of withdrawal, the Customer is required to inform Azienda Agricola Parano di Filesi Anselmo of the decision to withdraw from the purchase order by means of an explicit declaration to be sent within the aforementioned deadline by registered mail to the following address: Azienda Agricola Parano di Filesi Anselmo, Via Benedetto Croce, 24, Vasanello \u2013 01030 (VT). Azienda Agricola Parano di Filesi Anselmo will confirm receipt of the withdrawal notice to the Customer. <\/p>\n

In the event of exercising the right of withdrawal, Azienda Agricola Parano di Filesi Anselmo will refund the Customer the full amount of the returned goods including standard delivery costs, excluding redelivery costs which will remain the sole responsibility of the Customer, within 14 days from the date on which the withdrawal notice was received, without prejudice to the right of Azienda Agricola Parano di Filesi Anselmo to withhold the refund until the actual receipt of the Products, or until the Customer has demonstrated that he has returned the Products.<\/p>\n

The refund will be made using the same payment method used by the Customer, unless the Customer has expressly requested a different method.<\/p>\n

The right of withdrawal applies to the Product purchased in its entirety; therefore, if the Product has been opened, tampered with or altered in its aesthetic part so that it can no longer be put on sale, it will no longer be possible to exercise the withdrawal.<\/p>\n

The right of withdrawal is also excluded in the following cases, pursuant to art. 59 of Legislative Decree 21\/2014: <\/p>\n

order of Products made to measure or clearly personalized;<\/p>\n

ordering Products which are liable to deteriorate or expire rapidly;<\/p>\n

order of sealed Products which are not suitable for return for hygiene or health protection reasons or which have been opened after delivery.<\/p>\n

The Customer is informed and accepts that for reasons of hygiene and customer protection, the right of withdrawal is applicable only for Products purchased on the Site which can be returned and put back on the market without any risk to the health of Consumers.<\/p>\n

In cases of exclusion of the right of withdrawal, Azienda Agricola Parano di Filesi Anselmo will return the purchased Products to the Customer, charging the latter the shipping costs.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

8. Warranty and lack of conformity<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

In the event of defects in conformity of the Products sold by Azienda Agricola Parano di Filesi Anselmo, the Customer must immediately contact the company using the contact details provided on the Contacts page. <\/p>\n

The legal guarantees provided for in Articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. The Customer has the right, at his choice and provided that the type of Product allows it, to the restoration, free of charge, of the conformity of the Product through repair or replacement, or to an adequate reduction in price or to the termination of the contract. The Customer loses these rights if he does not report the lack of conformity to Azienda Agricola Parano di Filesi Anselmo within two months of the date on which he discovered the defect, provided that it is not a Product that by its nature is perishable or subject to expiry within a shorter period, in which case the defect must be reported within this reduced period. <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

9. Errors and limitations of liability<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The information relating to the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors for which Azienda Agricola Parano di Filesi Anselmo cannot be held responsible, except in the case of fraud or gross negligence. <\/p>\n

Azienda Agricola Parano di Filesi Anselmo reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to modify or update information at any time without prior notice, without prejudice to the Customer’s rights under these General Conditions and the Consumer Code.<\/p>\n

Except in the case of fraud or gross negligence, any right of the Customer to compensation for damages or to the recognition of an indemnity is excluded, as well as any contractual or extra-contractual liability of Azienda Agricola Parano di Filesi Anselmo for direct or indirect damages to persons and\/or things, caused by the failure to accept or fulfill, even partially, an order.<\/p>\n

The Customer agrees to release Azienda Agricola Parano di Filesi Anselmo from any liability in the event of legal actions, complaints, governmental or administrative actions, losses or damages (including legal costs and fees) caused by illicit use of the Products or services by the user or by anyone acting on his behalf.<\/p>\n

Azienda Agricola Parano di Filesi Anselmo cannot be held responsible for failure to fulfill its obligations that arise from causes outside the sphere of its foreseeable control or from causes of force majeure.<\/p>\n

The Customer undertakes to hold harmless from all losses, damages, liabilities, costs, charges, expenses, including legal fees, which may be suffered or incurred by Azienda Agricola Parano di Filesi Anselmo as a consequence of any failure to fulfill the obligations assumed with this contract.<\/p>\n

Azienda Agricola Parano di Filesi Anselmo promotes the responsible consumption of alcohol and excludes any liability on its part, except in the case of fraud or gross negligence, in the event of purchases made by minors under 18 years of age.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The sales contract between the Customer and Azienda Agricola Parano di Filesi Anselmo is deemed to be concluded in Italy and governed by Italian Law. For the resolution of disputes relating to the interpretation, execution or termination of these General Conditions or individual purchase orders if the Customer is a consumer pursuant to the Consumer Code, the court of his\/her municipality of residence or domicile will have exclusive jurisdiction if located in Italian territory; in all other cases, the territorial jurisdiction is exclusively that of the Court of Viterbo, any other competent court excluded. <\/p>\n

Pursuant to articles 1341 and 1342 of the Italian Civil Code, the Customer declares to have read and specifically accept the following articles of these General Conditions: 2 Choice and order of Products; 3 Information on Products; 4 Prices and shipments; 5 Payment methods and invoicing; 6 Transport and delivery; 7 Right of withdrawal; 8 Guarantee and lack of conformity; 9 Errors and limitations of liability; 10 Complaints; 11.
